Graham on Tuesday introduced legislation that will repeal a broad liability shield that has been protecting internet technology companies.

Section 230 of the Communications Decency Act is a decades old law that has faced scrutiny by members of both political parties, but most notably conservatives. President Donald Trump has threatened to veto the National Defense Authorization Act (NDAA) if it doesn’t include provisions for repealing Section 230.

Graham’s bill would effectively phase out Section 230 by January 1, 2023, providing Congress two years to replace it with a better alternative.

Graham said in a statement: “My legislation will repeal Section 230 on January 1, 2023, unless Congress acts sooner. Congress will have two years to find an acceptable alternative or allow the legal liability protections to go away.” “I’m hopeful that there will be bipartisan support for this approach.”

Social media providers and search engines have been accused of selectively censoring and omitting content for political purposes, a move that many consider to be censorship without consequence. Many lawmakers have directly accused the companies of partisan censorship.

Public opposition of Section 230 has dramatically increased this year as social media users have experienced a marked increase in content moderation by big-tech companies such as Facebook, Twitter, YouTube and Google.

Speaking on Fox’s Sean Hannity show on Monday, Graham said: “There’s two threats to conservatism: mass mail-in voting unverified and social media companies unregulated, unable to be sued when they take down the content of conservatives.”

There’s no business that I know of in America that can’t be sued for their actions and not subject to regulation by the government at any level, except big tech,” Graham explained.
