The potential incoming president also stated that he will issue a “standing order” that masks must be worn where he has authority to do so. His comments reaffirm his stance on mask mandates, one that he has long been establishing.

On November 18, Biden had said that he and a group of leading US governors had agreed to a national mask mandate, saying at the time, “let’s institute a mask mandate nationwide, starting immediately.

However, the director of the O’Neill Institute for National and Global Health Law at Georgetown University, Lawrence Gostin, said in November that “A national mandate is not possible because public health powers belong to the states, not the federal government… The federal government couldn’t implement its own mask mandates, nor could it force the states to do it.
