Pennsylvania: Federal Court Rejects Trump Appeal

The Third Circuit Court of Appeals on Friday rejected the Trump campaign's emergency appeal that sought to file a new lawsuit against Pennsylvania's election results.

The Third Circuit Court of Appeals on Friday rejected the Trump campaign’s emergency appeal that sought to file a new lawsuit against Pennsylvania’s election results.

The federal appeals court upheld a lower court’s dismissal of the lawsuit, which called for discarding certain categories of mail-in ballots. The ruling also squashes any chance for the campaign to obtain an injunction that would overturn the certification of Pennsylvania’s election results.

In the ruling, Trump-appointed Judge Stephanos Bibas wrote “Free, fair elections are the lifeblood of our democracy. Charges of unfairness are serious. But calling an election unfair does not make it so. Charges require specific allegations and then proof. We have neither here.”

Trump campaign senior legal adviser Jenna Ellis responded to the ruling, “The activist judicial machinery in Pennsylvania continues to cover up the allegations of massive fraud. We are very thankful to have had the opportunity to present proof and the facts to the PA state legislature. On to SCOTUS!”
